Opening Statement

As a concerned citizen of Cagayan de Oro City with children studying at the West City Central School, (WCCS) I see that there is need for a compilation of rights in Philippine public schools which include the Rights of the State, Schoolchildren, Parents, Teachers and School Administrators in Philippine Public Schools.

Below are my observations and aspiration:

MY OBSERVATIONS

My observations are on public school administrators of the past, present and future.

School administrators of the past were highly esteemed for their honesty, devotion to duty, excellent character and courtesy towards parents and teachers as well as their warm motherly attitude towards schoolchildren.

School administrators at present also possess the qualities above-described although I have observed acts of dishonesty, misconduct and neglect of duty on some of them.

I look forward that the Office of Secretary of the Department of Education would, from time to time get feedback from the public about the kind of services they receive from school administrators assigned in their region.

MY ASPIRATION

My aspiration is for us citizenry to have references pertaining to rights in public schools so I created a compilation called, ‘Karapatan sa Paaralang Pang-publiko’ in the hope that with it we become more prepared to assert our rights against discrimination, exploitation and neglect, or against acts falling under conduct unbecoming public servants, acts which are unethical or acts performed without proper authority from the Department Of Education (DepEd), including acts of omission or commission, and, or acts without concurrence of the majority of the members of a duly constituted General Parents-Teachers Association (GPTA), and, most importantly, acts which are unconstitutional or anti-democracy.

ARTICLE I – RIGHTS OF THE STATE

( * mentioning this is necessary in relation to an unusual but actual occurrence observed or experienced)

Section
  1. * It is the right of the State that every official and employee of the of the government shall at all times be accountable to the people and shall discharge their duties with utmost responsibility, integrity, competence, and loyalty, act with patriotism and justice, lead modest lives, and uphold public interest over personal interest. This right containing instructions on what are to be complied with and what are forbidden can be found in R.A. 6713 known as Code of Conduct and Ethical Standards for Public Officials and Employees as well as in the Code of Ethics of Public School Teachers. Complying with the instructions and avoiding what are forbidden by these and other related policies or laws are proof of one’s loyalty to the State;
  2. * It is the right of the State that officers and employees who are given salaries and various benefits possess loyalty to the democratic mechanisms of the country, perform their duties as paid servants of civil service and not as owners of their offices, and, in the case of the teachers, school administrators and officers of public schools the right of the State can be proven only through compliance of the policies of the Department of Education (DepEd), R.A. 6713, Code of Ethics of Public School Teachers and others;
  3. * It is the right of the State to use R.A. 3815 known as Revised Penal Code as may be deemed necessary to defend its laws and policies against any violation or non-compliance of what it has imposed.

ARTICLE II - RIGHTS OF SCHOOL CHILDREN

Section
  1. * It is the right of schoolchildren to be safe against any form of insult or degradation of their persons or dignity, such as describing them as ‘dull’, ‘foolish’, ‘stupid’ ‘panicky’ and other words that can cause them embarrassment;
  2. * It is the right of schoolchildren to be safe against any form of punishment requiring payment of money;
  3. * It is the right of schoolchildren to be safe from erroneous teaching by the teacher, such as spying at listing of names of classmates caught speaking vernacular and making him/her pay, that those that cannot be paid will be accumulated as ‘debt’ (this is widespread now in Philippine public elementary schools);
  4. * It is the right of schoolchildren to be free from any form of compulsory religious exercise, the teachers’ use of the phrase, “everybody stand up, let us pray” or any phrase with such equivalent which gives the children the impression that none in the class is exempt even if their religion is different. The Philippine Constitution forbids either the compulsion in religion or preventing its free exercise, even in the United States no less than the Supreme Court outlawed or banned the recitation of the “Lord’s Prayer” and reading of the Bible which it describes as unconstitutional on the basis of the separation of the church and state, emphasizing that one’s exercise of right should not result to denying others of their rights;
  5. * It is the right of schoolchildren to be safe in their things inside the school;
  6. * It is the right of schoolchildren to be safe in all forms of physical harm;
  7. * It is the right of schoolchildren to be safe in any form of intimidation from anyone particularly among school or personal security of the school administrator;
  8. * It is the right of schoolchildren to see their ratings before the next periodical examination;
  9. * It is the right of schoolchildren to see their test papers to check the grade received in the examination given during enrollment to determine who will be qualified to be in the FL1 Section;
  10. * It is the right of schoolchildren that their rights under R.A. 7610 known as; Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act”;

ARTICLE III - RIGHTS OF THE PARENTS
Section
  1. * It is the right of the parents to see that the school administrator recognizes the ‘Declaration of Principles and State Policies of the 1987 Philippine Constitution which says, “The Philippines is a democratic and republican State” by being democratic in dealing with the parents and teachers inside the school which he/she administers and not a dictator who, without due process, dictate whatever he/she wants to implement whether the great majority who will be affected by what he/she wants to implement like it or not;
  2. * It is the right of parents to see that the school administrator possesses the personality fit for a good and loyal servant of civil service – not a personality of a hated tyrant, intimidating head who is neglectful of his/her obligations;
  3. * It is the right of parents that the school administrator possesses a good reputation – not one whose reputation is unacceptable to many people specially on the issue that has to do with money or property of the public;
  4. * It is the right of parents to see that the school administrator has respect to his/her superior the Secretary of the Department of Education by obeying it’s instructions contained in Department Order No. 54 paragraph II sub-paragraph 3 pertaining to GPTA elections;
  5. * It is the right of parents to see that the school administrator has respect to his/her superior the Secretary of the Department of Education by obeying it’s instructions contained in Department Order No. 54 paragraph III sub-paragraph 2 pertaining to GPTA general assembly;
  6. * It is the right of parents to see that the school administrator has loyalty to the Department of Education (DepEd) by obeying the provisions of the Code of Ethics of Public School Teachers Article X Section 3 that prohibits sale of books;
  7. * It is the right of parents to see an existing and functioning Parents-Teachers Association (GPTA;
  8. * It is the right of the GPTA general membership that the school administrator consult them before he/she undertakes any fund-raising project that will cause expenditures among parents and the said consultation should include a documented detail of the needs such as the amount of labor and materials and others, to have sufficient deliberations on the proposed project. The Homeroom PTAs have no autonomous power or right to launch fund-raising projects of school-wide coverage if it does not have any endorsement from the GPTA – the absence of GPTA participation in fund-raising projects will only invite suspicion;
  9. * It is the right of parents to see a GPTA Bulletin Board in an appropriate place in the school as compliance to Deped Order No. 54 Paragraph VIII Sub-Paragraph 4;
  10. * It is the right of parents to see in the GPTA Bulletin Board bits of information such as Announcements, Approved Resolutions, Required Reports at Financial Statements, as compliance to the Deped Order No. 54 Paragraph Viii Sub-Paragraphs 1 To 4; it is necessary to post a list of amount of money accumulated in the fund-raising project, the kinds and amount of expenditures and the amount remaining;
  11. * It is the right of parents to see in the GPTA Bulletin Board the list of turn-over papers / documents and financial statement between the GPTA Board of Directors and officers of the previous school-year and GPTA Board of Directors and Officers of the following school-year. According to the DepEd Order No. 54 paragraph 10, such turn-over should not be later than June 30; the said turn-over of all GPTA documents to school heads or school administrator only means that the school administrator has obligation to show proof of compliance and will be held liable for not having such proof;
  12. * It is the right of the parents to have a duly established and functioning GPTA whose Board of Directors and Officers are properly disclosed for the information and guidance of everyone;
  13. * It is the right of parents to hear and read the announcement from the school administration pertaining to the schedule of forthcoming GPTA election (30 days after the 1st day of opening of class) – the school administrator needs proof of having complied this;
  14. * It is the right of parents that those among them elected as Homeroom PTA Presidents to be invited to attend the GPTA election of 15 Board of Directors and 5 Officers and have the chance to vote and be voted; the school administrator needs proof that he/she made such invitation because the absence of such invitation would mean either of the two: that no election was ever held at all, or, that an election was held but only some were invited while the others were not invited or excluded from such exercise which already tantamounts to electoral sabotage;
  15. * It is the right of parents of the GPTA general membership to hear the announcement or read the publication of the school administrator pertaining to the result of the election of Board of Directors and Officers to that those elected will be known; the secrecy, hidden or non-announcement or publication of the result of the election is a clear indication of an electoral sabotage;
  16. * It is the right of parents of the GPTA general membership to be able to interact with the GPTA Board of Directors and Officers and it is the duty of the school administrator to ensure that this happens as a proof that there is freedom prevailing in such school because without such freedom, it would mean that the school is being administered by an anti-democracy;
  17. * It is the right of parents of GPTA general membership to have a GPTA Office/Parents Lounge where the board of Directors and Officers are independent and able to freely contemplate and discuss things and in order that they can be readily found and approached by fellow-parents or GPTA members; the GPTA should have its own place and should not share only with other offices because that kind of set up would invite suspicion that the GPTA is controlled or manipulated by the school administrator; it is the duty of the school administrator to allocate – if there is none yet – a place for the GPTA because this is his/her proof that there is democracy prevailing in such school and a proof that the school administrator is not anti-democracy;
  18. * It is the right of parents to continue enjoying any GPTA Office/Parents Lounge that was constructed through the money and efforts of the former parents; in case there shall be need to close and use it in whatever way, the school administrator should first convey the matter to the greater number of the GPTA such intention as manifestation of good manners and in order to have a deliberation until an agreement is reached such as allocation of a new area and set up that is fair or just and acceptable to both sides;
  19. * It is the right of parents that the school administrator as adviser also of the GPTA according to DepEd Order No. 54 paragraph III sub-paragraph 2, will, call for a general assembly or gathering of all the parents and all the teachers twice within a school-year to jointly discuss whatever problems there may be that needs to be solved or some needs that need to be addressed; it is the duty of the school administrator to ensure that this happens as proof that there is democracy prevailing in such school and that the school administrator is not anti-democracy;
  20. * It is the right of parents of the parents that they see the school administrator truly working or performing civil service, not one who is often notice or heard to be absent that’s why there are backlogs in his/her work or unable to finish his/her work within a timetable and there are jobs he/she just passed to his/her subordinates;
  21. * It is the right of parents that the school administrator has respect for Code of Ethics of Public School Teachers Article X Section 3 that prohibits teachers from selling books to pupils;
  22. * It is the right of parents that the school administrator has respect to their dignity as human beings and respect to her duty as promoter of education – he/she should not utter tough words or provocative words, or those with coercive tone or intimidation, specially on the stage;
  23. * It is the right of parents that the school administrator obeys the Election laws, not one who hangs gigantic photographs of high officials of the country outside her office as it the school she administers is already among the designated political campaign area or an extension of Malacañang that’s why nobody can afford to challenge her;
  24. * It is the right of parents that no member of his/her family will act arrogantly, bully inside or outside of the school wherein his authoritative moves seen by the public as if the operation of the school has been under conjugal control;
  25. * It is the right of parents to be always safe inside and outside the school, free of any surveillance inconvenience or spying and coercion by any of the people close to the school administrator;
  26. * It is the right of parents to be always safe against any form of intimidation or threat by way of stare or bodily movement by any official of DepEd who should not be carried away by insinuation of a bully school administrator;
  27. * It is the right of parents that whenever an agency of the government conveys to the DepEd of a Region an indication that a problem exist between parent and teacher inside a school, the official of the said Region should take action / investigate if there really was a problem or none or whether either of the parties is aggrieved, the action or investigation conducted by the DepEd official will serve as his proof that he/she is responsible, thoughtful or reliable official of the Region and deserving of the function entrusted to him/her;
  28. * It is the right of parents to see that the DepEd of the Region has taken action on the complaints of the people against a school administrator who became known for being controversial or notorious due to the many complaints against him/her, that on many occasions was aired through the media like Bombo Radio; the inaction of the said DepED will give impression to the public that the sufferings of the people in the hands of the said school administrator and its allies are fault of DepEd itself;
  29. * It is the right of parents in every Region in the country, that the Secretary of the Department of Education would once in a while send fact-finding/monitoring team without prior announcement or notice to the local DepEd, that what will do is to go around the different parts of the region to conduct interviews with the residents of the place and find out whether the instruction of the DepEd such as DepEd order No. 54 and others are being complied by the school administrator of the schools of the said place as to the kind of problems they have and about what kind of problems they have pertaining to their schools;
ARTICLE IV - RIGHTS OF TEACHERS
Section
  1. * It is the right of the Teachers that the school administrator has respect upon their dignity as human beings and as teacher – they should not hear from her unsound talk or talks such as those containing pressures or threats;
  2. * It is the right of the Teachers to be free from any unjust instructions from the school administrator such as that which would give undue benefit to the one giving instructions which is forbidden in civil service;
  3. * It is the right of the Teacher that the schoolchildren and parents have respect to their dignity as human beings and as teachers – they should not be object of unruly language that is harsh of words containing pressures or threats;
  4. * It is the right of the Teachers that they do not see any unethical or undesirable sights in the offices and surroundings of the school, such as hanging around of a member of the school-official who has not official business and not an employee of the school;
  5. * It is the right of the Teachers to stop and reprimand any member of the school-officials family found interfering with the jobs and activities of the school, especially those pertaining to security concerns of the school;
  6. * It is the right of the Teachers that the school administrator educate them about the DepEd Orders and other important polices of DepEd;
  7. * It is the right of the Teachers that they are first given adequate knowledge or orientation whoever will be tasked to perform important roles, such as performing as moderators of the elections mentioned in DepEd Order No. 54;
  8. * It is the right of the Teachers that they receive appropriate action or moral support from the school administrator in the legitimate problems they bring to her as their leader; the inaction of the leader on the problems of her teachers is dereliction of duty / act of neglect which is punishable by law
  9. * It is the right of the Teachers that they see the school administrator truly working or performing civil service, not one who is always absent that is why he/she often has backlog in his/her tasks or unable to finish them within a timetable and there are jobs that he/she just pass on to his/her subordinates;
ARITICLE V – RIGHTS OF THE SCHOOL ADMINISTRATOR
Section
  1. * It is the right of the school administrator that he/she given due respect by the schoolchildren, parents and teachers as administrator of the school;
  2. * It is the right of the school administrator to be free from any form of unjust instruction of a superior such as instruction that would give financial benefits to the one giving instructions or any instruction prohibited in civil service;
  3. * It is the right of the school administrator that every document due for her signature be scrutinized first to ensure completeness and correctness or the contents free of errors;
  4. * It is the right of school administrator that she be immediately informed by the teachers about any problem or issue that might affect the reputation or credibility of the school

Salitang Pambungad

Bilang mamamayan ng syudad ng Cagayan de Oro na ngayon ay may mga anak na mag-aaral ng West City Central School, (WCCS) nakikita ko na mahalagang magkaroon ng pinag-samang mga karapatan sa mga paaralang publiko na kinabibilangan ng mga Karapatan ng Estado, mga Mag-aaral, mga Magulang, mga Guro at mga Administrador ng paaralang pang-publiko (TKPP).

Narito ang aking mga obserbasyon at pangarap:

ANG AKING OBSERBASYON

Ang aking obserbasyon ay nakatoon sa mga Administrador ng mga paaralan ng lumipas na panahon, ng kasalukuyan at ng hinaharap.

Ang mga Administrador ng mga eskwela ng mga nakaraang panahon ay tiningala dahil sa kanilang katapatan, pagmamahal sa tungkulin, kagandahang-asal at respeto sa mga magulang at mga guro at sa kanilang mainit na pakikitungo sa mga batang mag-aaral.

Ang mga Administrador ng mga eskwela ng kasalukuyang panahon ay nagtataglay din ng mga katangiang nabanggit sa unahan bagamat kapuna-puna ang kawalan ng katapatan, maling asal at pagiging pabaya sa tungkulin ng ilan sa kanila.

Ako’y umaasa na hindi magtatagal ang tanggapan ng Kalihim ng Edukasyon ay maya’t-mayang mangangalap ng impormasyon derekta mula sa publiko tungkol sa uri ng serbisyo na natatanggap nila mula sa mga Administador na nakatalaga sa kanilang rehiyon.

ANG AKING PANGARAP

Pinangangarap ko na ang mga mamamayang ay magkaroon ng mga basehan hinggil sa mga karapatan sa mga paaralang pang-publiko, kaya gumawa ako ng kumpilasyon ng kung tawagin, ‘Karapatan sa Paaralang Pang-publiko’. Umaasa akong mula sa maraming impormasyong mababasa dito ay magiging mas handa nang igiit ng mga mamayan ang kanilang karapatan laban sa diskriminisyon, pananamantala at pagpapabaya sa tungkulin, o laban sa mga pag-uugaling hindi angkop sa mga tagapaglingkod ng bayan, mga gawaing lihis sa kagandahang-asal o mga gawaing walang awtorisasyon mula sa Department of Education (DepEd), kasama na ang acts of omission of commission, o mga gawaing walang pagsang-ayon ng nakararaming kasapi ng wastong tatag na General Parents-Teachers Association, at, higit sa lahat, mga gawaing labag sa Saligang-Batas o kuntra-demokrasya.

  1. * Karapatan ng Estado na ang bawat opisyal at emplayado ng gobyerno ay sa lahat ng panahon may pananagutan sa taumbayan at kailangang gumanap ng kanilang mga tungkulin ng mayroong mataas na antas ng responsibilidad, integradad, kakayahan at katapatan, pagkamakabayan at hustisya at mamumuhay ng hindi magarbo, at ang kapakanang pampubliko ang inuuna sa kapakanang pangsarili. Ang karapatang ito na naglalaman ng mga utos kung anong mga nararapat gawin at kung anong mga ipinagbabawal ay mababasa sa R.A. 6713 na kilala bilang Code of Conduct and Ethical Standards for Public Officials and Employees, mayroon din sa Code of Ethics of Public School Teachers. Ang pagsunod sa mga utos at pag-iwas sa mga pinagbabawal ng mga ito at ng iba pang mga kaugnay na alituntunin o batas ay katibayan ng pagiging matapat sa Estado;
  2. * Karapatan ng Estado na bawat opisyal at kawani na binibigyan nito ng pasweldo at iba’-ibang benipisyo ay nagtataglay ng katapatan sa mga maka-makademokrasyang mekanismo ng bansa at gaganap sa kani-kanilang mga tungkulin bilang mga bayarang alagad ng serbisyo sibil at hindi bilang mga may-ari ng opisina, at, sa hanay mga guro, school-administrator at mga opisyal ng mga paaralang pampubliko ang katapatan sa estado ay mapapatunayan lamang sa pamamagitan ng pagsunod sa mga alituntunin ng Department of Education, R.A. 6713, Code of Ethics of Public School Teachers at iba pa;
  3. * Karapatan ng Estado na gamitin anumang sandali ang R.A. 3815 na kilala bilang Revised Penal Code upang ipagtanggol ang mga batas o alitutuntuning pinaaiiral nito laban sa anumang paglabag o mga hindi pagsunod sa mga pinaiiral nito.
ARTICLE II - KARAPATANG PANG-MAG-AARAL

Section

  1. * Karapatan ng mga mag-aaral na maging ligtas sa anumang insulto o panlalait sa kanilang pagkatao o dignidad, tulad ng pagtawag sa kanila ng mga salitang: ‘bobo’ ‘gago’ ‘loko-loko’ ‘istupido’ ‘tarantado’ at iba pang mga salitang magiging dahilan na silay mapahiya;
  2. * Karapatan ng mga mag-aaral na maging ligtas sa anumang uri ng parusang may perang ibabayad;
  3. * Karapatan ng mga mag-aaral na maging ligtas sa mga maling turo ng guro, tulad ng paniniktik at paglilista ng mga pangalan ng classmates na mahuling nagsalita ng vernacular at pagmultahin ito, na ang mga hindi agad nabayaran ay maiipon bilang ‘utang’ (laganap na ito ngayon sa Philippine public elementary schools);
  4. * Karapatan ng mga mag-aaral maging malaya sa anumang pamimilit sa kanilang sumabay bilang obligasyon sa among gawaing pang-relihiyon, ang paggamit ng mga guro ng mga salitang, “magsitayo lahat, atmanalangin tayo” o ng anumang mga pananalitang ganoon ang magiging pakahulugan na magbibigay impresyon sa mga mag-aaral na walang sinumang exempted kahit na ang kanilang relihiyon ay iba. Ang Saligang Batas ng Pilipinas ay nagbabawal sa pagkaroon ng pamimilit sa relihiyon o sa pagpigil ng karapatan nito, kahit sa Estados Unidos ang Korte Suprema mismo ang nagdeklara na ito ay labag sa batas at ipinagbawal ang pag recite ng “Lord’s Prayer” at pagbabasa ng Bibliya sa mga paaralang publiko na umano ay labag sa konstitusyon, dahil sa diwa ng pagkakahiwalay ng Simbahan ats ng Estado, nilinaw na ang paggamit ng tao ng kanyang kalayaan ay hindi dapat humantong sa pagkawala ng kalayaan ng ibang tao:
  5. Karapatan ng mga mag-aaral na maging ligtas ang kanilang mga gamit pang-eskwela;
  6. Karapatan ng mga mag-aaral na maging ligtas sa anumang pisikal na pananakit;
  7. * Karapatan ng mga mag-aaral na maging ligtas sa anumang uri ng pananakot kaninuman partikular na sa mga school o personal security ng school administrator;
  8. * Karapatan ng mga mag-aaral na makita ang kanilang ratings bago sumapit ang susunod na periodical exams;
  9. * Karapatan ng mga mag-aaral na makita ang kanilang test papers upang masuri ang gradong natanggap sa pagsusulit na ibinigay sa enrollment upang mabatid kung sino ang mga kwalipikadong mapabilang sa FL1 Section;
  10. * Karapatan ng mga mag-aaral na mapangalagaan ang kanilang mga karapatan sa ilalim ng R.A. 7610 na mas kilala bilang, “Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act.”

ARTICLE III - KARAPATANG PANG-MAGULANG

Section
  1. * Karapatan ng mga magulang na makita na ang school administrator ay Kumikilala sa ‘Declaration of Principles and State Policies ng 1987 Philippine Constitution na nagsasabing, “The Philippines is a democratic and republican State” sa pamamagitan ng pagiging maka-demokrasya sa pakikitungo sa mga magulang at mga guro sa loob ng paaralang kanyang pinamamahalaan at hindi diktador na nagdedikta ng wala sa tamang proceso, ng anumang nais nyang pairalin sa ayaw o sa gusto ng nakararaming maaapektuhan ng kanyang gagawin;
  2. * Karapatan ng mga magulang na makita na ang school administrator ay nagtataglay ng personalidad na angkop sa isang mabuti at matapat na alagad ng serbisyo sibil - hindi personalidad ng isang kinamumuhiang mapang-api, mapanakot na pinunong pabaya sa tungkulin;
  3. * Karapatan ng mga magulang na ang school administrator ay nagtataglay ng magandang reputasyon - hindi yaong ang reputasyon ay hindi katanggap-tanggap sa maraming tao lalo na sa mga isyung may kinalalaman sa pera o propriedad na pag-aari ng publiko;
  4. * Karapatan ng mga magulang na makitang mayroong respeto ang school administrator sa kanyang superior na Secretary ng Department of Education sa pamamagitan ng pagsunod sa utos nitong nakasaad sa Department Order No. 54 Paragraph II Sub-Paragraph 3 patungkol sa GPTA elections;
  5. * Karapatan ng mga magulang na makitang mayroong respeto ang school administrator sa kanyang superior na Secretary ng Department of Education sa pamamagitan ng pagsunod sa utos nitong nakasaad sa Department Order No. 54 Paragraph III Sub-Paragraph 2 patungkol sa GPTA general assembly;
  6. * Karapatan ng mga magulang na makitang may katapatan ang school administrator sa Department of Education sa pamamagitan ng pagsunod sa mga probisyon ng Code of Ethics of Public School Teachers Article X Section 3 na nagbabawal sa pagbebenta ng libro;
  7. * Karapatan ng mga magulang na makakita ng umiiral at kumikilos na General Parents-Teachers Association (GPTA);
  8. * Karapatan ng mga magulang ng kalakhang GPTA na kunsultahin sila ang school administrator bago s’ya gumawa ng anumang fund-raising project na magdudulot ng gastusin sa mga magulang, at ang nasabing kunsultasyon ay dapat may kalakip na dokumentadong detalye ng mga pangangailangan tulad ng halaga ng labor at materials at iba pa, upang magkaroon ng sapat na deliberasyon ang inimumungkahing proyekto. Ang homeroom PTAs ay walang kapangyarihang autonomous o karapatang naglulunsad ng fund-raising projects na may malawak na saklaw kung wala itong endorsement mula sa GPTA - ang kawalan ng partisipasyon ng GPTA sa fund-raising projects ay magdudulot lamang ng hinala;
  9. * Karapatan ng mga magulang na makakita ng GPTA Bulletin Board sa angkop na lugar ng eskwela bilang pagsunod sa Deped Order No. 54 Paragraph VIII Sub-Paragraph 4;
  10. * Karapatan ng mga magulang na makita sa GPTA Bulletin Board ang mga impormasyon tulad ng Announcements, Approved Resolutions, Required Reports at Financial Statements, bilang pagsunod sa Deped Order No. 54 Paragraph Viii Sub-Paragraphs 1 to 4; Kailangang mapaskel ang talaan ng mga halagang nalikom sa fund-raising project, mga uri at halagang pinag-gastusan at halagang naiwan;
  11. * Karapatan ng mga magulang na makita sa GPTA Bulletin Board ang listahan ng mga nalipat o naturn-over na mga papeles / dokumento at financial statement sa pagitan ng GPTA Board of Directors at mga Officers ng nagdaang school-year at GPTA Board of Directors at mga Officers ng sumunod na school-year. Ayon sa DepEd Order No. 54 PARAGRAPH 10 hindi dapat lumagpas ng June 30 ang nasabing turn-over ng lahat ng GPTA documents sa school heads o school administrator at nangangahulugan ito na ang school head o school administrator ang mayroong obligasyon na magpakita ng katibayan ng patupad nito at pananagutan sa hindi pagkakaroon ng nasabing katibayan;
  12. * Karapatan ng mga magulang na magkaroon ng wastong tatag at gumagana na GPTA kung saan ang mga pangalan ng Board of Directors at mga Officers ay nabunyag sa wastong paraan para sa impormasyon at gabay ng lahat;
  13. * Karapatan ng mga magulang na makarinig at makabasa ng announcement mula sa school administration patungkol sa schedule ng gaganaping GPTA election (30 days after the 1st day of opening of class) – Kailangan ng school administrator ng katibayan na naipatupad ito;
  14. * Karapatan ng mga magulang na yaong mga nahalal na Homeroom PTA Presidents ay maimbitahan na dumalo sa gaganaping GPTA election of 15 Board of Directors and 5 Officers at magkaroon ng pagkakataong bumoto at mahalal; kailangan ng school administrator ng katibayan na nagpagawa sya ng naturang imbitasyon pagkat ang hindi pagpadala ng imbitasyon ay mangangahulugan ng alin sa dalawa: na wala talagang ginanap na anumang eleksyon, o kaya, na nagkaroon ng eleksyon ngunit ilan lamang ang inimbitahan samantalang ang iba ay hindi inimbitahan o hindi isinama sa nasabing proseso at katumbas na ng electoral;
  15. * Karapatan ng mga magulang ng kalakhang GPTA na marinig ang announcement o mabasa ang publicity ng school administrator tungkol sa resulta ng election of Board of Directors and Officers upang makilala kung sino-sino ang mga nahalal; ang paglilihim, pagtatago o hindi pag anunsyo o pagpublish ng ng resulta ng election ay malinaw indikasyon na nagkaroon ng electoral sabotge;
  16. * Karapatan ng mga magulang ng kalakhang GPTA na malayang makaugnayan ang Board of Directors at mga Opisyal ng GPTA at tungkulin ng school administrator na tiyaking nangyayari ito bilang katibayan na may umiiral na kalayaan sa nasabing paaralan pagkat kung walang kalayaan sa loob, nangangahulgan lamang na ang paaralan ay pinamamahalaan ng anti-democracy;
  17. * Karapatan ng mga magulang ng kalakhang GPTA ang pagkaroon ng GPTA Office/Parents Lounge kung saan ang Board Members at Officers ay independiente at malayang makapag-isip at tumalakay ng mga bagay at upang madali silang makita at malapitan ng kapwa-magulang o kasapi ng GPTA; kinakailangan ng GPTA ng sariling lugar at dapat hindi ito nakikisilong lamang sa ibang tanggapan pagkat ang ganong set up ay magdudulot ng hinala na ang GPTA ay kontrolado o namamanipula ng school administrator; tungkulin ng school administrator na maglaan – kung wala pa – ng lugar para sa GPTA pagkat ito ang magiging katibayan nya na mayroong umiiral na demokrasya sa nasabing paaralan at katibayan na ang school administrator ay hindi anti-democracy;
  18. * Karapatan ng mga magulang na patuloy na makinabang sa anumang GPTA Office/Parents Lounge na naipatayo sa pamamagitan ng pera at pagsumikap ng mga naunang magulang; kung magkaroon man ng pangangailangan na ipasara at gamitin ito sa ibang paraan, kinakailangan muna ng school administrator na iparating sa nakararaming myembro ng GPTA ang nasabing intension bilang pagpapakita ng kagandahang-asal at upang magkaroon ng deliberasyon hanggang sa magkaroon ng pakakasundo tulad ng paglalaan ng kapalit na lugar at kaayusan na patas o makatarungan at katanggap-tanggap sa magkabilang panig;
  19. * Karapatan ng mga magulang na ang school administrator bilang adviser din ng GPTA ayon sa DepEd Order No. 54 paragraph III sub-paragraph 2, ay magpatawag ng General Assembly o pagtitipon ng lahat ng magulang at lahat ng guro 2 beses sa loob ng isang school-year upang magkasamang talakayin ang anumang problema kung mayroon man na dapat malutas o pangangailangang dapat matugunan; tungkulin ng school administrator na tiyakin na nangyayari ito bilang katibayan na mayroong umiiral na demokrasya sa nasabing paaralan at ang school administrator ay hindi anti-democracy;
  20. * Karapatan ng mga magulang na ang school administrator ay nakikita nila na totoong nagtatrabaho o gumaganap ng civil service, hindi yung palaging napapansin o naririnig na absent kaya’t madalas na may backlog sa kanyang mga gawain o hindi nakakatapos ng gawain sa loob ng takdang panahon at may mga trabahong ipinapasa na lamang sa kanyang subordinates;
  21. * Karapatan ng mga magulang na ang school administrator ay mayroong respeto sa Code of Ethics of Public School Teachers Article X Section 3 na nagbabawal sa sinumang guro na magbenta ng aklat sa mga bata;
  22. * Karapatan ng mga magulang na ang school administrator ay mayroong respeto sa kanilang dignidad bilang tao at respeto sa kanyang tungkulin bilang tagasulong ng edukasyon - hindi s’ya dapat magbitiw ng magaspang na pananalita o mga pananalitang mapaghamon, o may tema ng panggigipit o pagbabanta, lalo na sa ibabaw ng stage;
  23. * Karapatan ng mga magulang na ang school administrator ay sumusunod sa election laws, hindi nagsasabit ng higanteng mga larawan ng matataas na opisyal ng bansa sa labas ng kanyang tanggapan na para bang ang paaralang pinamamahalaan nya ay kabilang na sa designated campaingn area o kaya extension ng Malacañang kaya’t walang pwedeng kumontra sa kanya;
  24. * Karapatan ng mga magulang na walang myembro ng pamilya ang school administrator na mag-aastang arogante, siga-siga o bully sa loob man o labas ng paaralan kung saan ang authoritative na kilos nitong nakikita ng taumbayan na para bang ang operasyon ng paaralan ay sumailalim na sa ‘conjugal control’;
  25. * Karapatan ng mga magulang na palaging ligtas sa loob at labas ng paaralan, malaya sa anumang surveillance movements o paniniktik at panggigipit ng sinumang mga taong malapit sa school administrator;
  26. * Karapatan ng mga magulang na maging ligtas sa anumang uri ng intimidasyon o paninindak sa pamamagitan ng tingin o kilos o tingin at kilos ng sinumang opisyal ng DepEd na hindi dapat nagpapatangay sa insinuation ng isang bully na school administrator;
  27. * Karapatan ng mga magulang na kapag ang isang tanggapan ng gobyerno ay nagparating sa DepEd ng Region ng indikasyon na mayroong umiiral na problema sa pagitan ng magulang at guro sa loob ng isang paaralan, ang opisyal ng nasabing Region ay dapat gumawa ng aksyon / imbistigasyon kung mayroon talagang problema o wala o kung mayroong naagrabyado sa magkabilang panig; ang gagawing aksyon o imbistigasyon ng opisyal ng DepEd ay magsisilbing katibayan na s’ya ay responsible, maalalahanin o maaasahang opisyal ng Region at karapat-dapat sa tungkuling ipinagkatiwala sa kanya;
  28. * Karapatan ng mga magulang na makitang may ginagawang aksyon ang DepEd ng Rehiyon sa mga reklamo ng mga mamamayan tungkol sa sinumang school administrator na nagiging kilala sa pagiging kotrobersyal o notorious sanhi ng maraming reklamo laban sa kanya, na sa ibat-ibang pagkakataon ay naibulalas sa media tulad ng Bombo Radio; ang pagsasawalang-kibo ng nasabing sangay ng DepEd ay magbibigay impression sa publiko na ang pagdurusa ng taumbayan sa kamay ng naturang school administrator at sa mga kapanalig nito, ay kasalanan ng DepEd mismo.
  29. * Karapatan ng mga magulang ng bawat Rehiyon sa bansa, na ang tanggapan ng Secretary of Department of Education ay paminsan-minsan napapadala ng fact-finding/monitoring team na walang announcement o notice sa local DepEd, na ang gagawin ay maglibot sa iba’t-ibang panig ng rehiyon upang magsagawa ng interviews sa mga mamamayan ng lugar at malaman kung ang mga ipinag-uutus ng DepEd tulad ng DepEd Order No. 54 at iba pa ay sinusunod ng mga school administrators ng mga paaralan ng nasabing lugar at kung anong mga suliranin meron sila patungkol sa mga paaralan nila.

ARTICLE IV - KARAPATANG PANG-GURO
Section
  1. * Karapatan ng mga Guro na ang school administrator ay mayroong respeto sa kanilang dignidad bilang tao at bilang guro - hindi sila dapat makarining sa kanya ng mga magaspang na pananalita o mga pananalitang may tema ng panggigipit o pagbabanta;
  2. * Karapatan ng mga Guro na maging malaya sa anumang hindi-makatarungang utos ng school administrator tulad ng utos na magdudulot ng hindi nararapat na benepisyo sa nag-uutos na ipinagbabawal sa serbisyo sebil;
  3. Karapatan ng mga Guro na ang mga mag-aaral at mga magulang ay mayroong respeto sa kanilang dignidad bilang tao at bilang guro - hindi sila dapat pinagsalitaan ng mga salitang maton na mabalasik o mga salitang may temang panggigipit o pagbabanta;
  4. * Karapatan ng mga Guro na walang anumang unethical o hindi kanais-nais na tanawin silang makikita sa mga tanggapan at pali-paligid ng paaralan, tulad ng pagtatambay doon ng miyembro ng pamilya ng school-official na wala namang official business at hindi emplyado ng paaralan,
  5. * Karapatan ng mga Guro na pigilin at sitahin ang sinumang myembro ng pamilya ng school officials na makikitang nakikialam sa mga gawain at aktibidad ng paaralan, lalo na yaong may kinalalaman sa seguradad ng eskwelahan ;
  6. * Karapatan ng mga Guro na ipaunawa sa kanila ng school administrator ang mga probisyon ng DepEd Orders at iba pang mahahalagang polisiya ng DepEd
  7. * Karapatan ng mga Guro na magkaroon muna ng sapat na kaalaman o orientation ang sinumang aatasan nitong gumanap ng mga mahahalagang tungkulin, tulad ng pagganap bilang mga tagapangasiwa ng mga eleksyon na nababanggit sa DepEd Order No. 54;
  8. * Karapatan ng mga Guro na makatanggap ng kaukulang action o moral support mula sa school administrator sa mga lihitemong problema na kanilang idudulog sa kanya bilang lider nila, ang pagsasawalang-kibo ng lider sa mga problema ng kanyang mga guro ay Dereliction of Duty / Act of Neglect o pagpabaya sa tungkulin na pinarurusahan ng batas;
  9. * Karapatan ng mga Guro na ang school administrator ay nakikita nila na totoong nagtatrabaho o gumaganap ng civil service, hindi yung palaging absent kaya’t madalas na may backlog sa kanyang mga gawain o hindi nakakatapos sa loob ng takdang panahon at may mga trabahong ipinapagawa na lamang sa kanyang subordinates;

ARITICLE V - KARAPATANG PANG-ADMINISTRADOR
Section
  1. * Karapatan ng school administrator na ibigay sa kanya ng mga mag-aaral, mga magulang at mga guro ang Respeto sa kanya bilang administrador ng paaralan;
  2. Karapatan ng school administrator na maging malaya sa anumang uri ng hindi-makatarungang utos ng superior tulad ng utos na magdudulot ng pakinabang pinansyal sa nag-uutos o anumang utos na ipinagbabawal sa serbisyo sebil;
  3. * Karapatan ng school administrator na bawat dokumentong palalagdaan sa kanya ay nabusisi muna upang matiyak na kumpleto at wasto o walang mali ang mga nilalaman;
  4. Karapatan ng school administrator na ipabatid agad ng mga guro sa kanya ang anumang suliranin o isyu na maaring makaapekto sa reputasyon o kridibilidad ng paaralan;
